DWI CHARGE
Prosecutors from the office of Kings County District Attorney Charles Hynes this week filed charges of criminally negligent homicide and manslaughter, as well as driving while intoxicated, against one of the drivers in a Remsen Avenue collision that killed a budding new lawyer the day after Christmas. A DWI charge was also filed against the driver of the car from which passenger Amanda Kandial, 36, was thrown and died as a result of the impact of the crash, which happened at the corner of Ditmas Avenue at about 2:30 a.m. last Friday. According to Sandy Silverstein, a spokesman for the district attorney, Garvin Brown, 23, was driving his 1996 Nissan Maxima north on Remsen Avenue and collided with a 1993 Toyota driven by Russell Viera, 25, who was traveling west on Ditmas Avenue. The indictment states that witnesses told police the Maxima and a late-model Nissan Sentra had allegedly been "driving side-by-side at 60-65 miles per hour" on Remsen Avenue when the Sentra stopped for a red light. The Maxima, however, continued driving through the red light and collided with the Toyota, the indictment says. Witnesses said the victim was in the back seat of the Camry and was thrown from the car. Viera and another passenger were both treated at Brookdale Hospital and released and Viera was arrested. Besides the dwi charge, he has been accused of driving without proper insurance. Other charges are pending further investigation, according to the district attorney’s spokesman. Brown, meanwhile, was also treated and released from the hospital and then arrested. Additional charges against him include reckless endangerment and reckless driving.
